Terms of Use

This page is the agreement between you and Folia. We've written it to be readable, but it's still a real contract, so please take a minute with it.

Folia is operated by Will Sykora as a sole proprietor based in Maryland. "Folia," "we," and "us" mean that operator. "You" means you, the person using the site at folia.farm or app.folia.farm. These Terms and our Privacy Policy govern your use of Folia. If you don't agree, that's completely fine, but please don't use Folia.

How you accept these Terms

How you agree to these Terms depends on how you use Folia.

Free use. When you use the free parts of Folia, including running an analysis without an account, you agree to these Terms and the Privacy Policy by using the site. We show a clear notice with a link to these Terms at the point where you run an analysis, so you can read them before you rely on any result.

Paid features. When you sign up for any paid feature, you agree to these Terms and the Privacy Policy by taking an affirmative action we present to you, such as checking an "I agree" box or clicking a button that says you agree, before your payment is taken. We record that acceptance.

If you don't agree to these Terms, please don't use Folia.

Who can use Folia

You need to be at least 18 and able to enter into a contract. By accepting these Terms, you're telling us that's true. Folia is meant for use in the United States.

What Folia is

Folia sources publicly available information about a location you choose, its terrain, soil, climate, water, and hazards, and turns it into an analysis and a set of considerations for growing certain crops, like grapes and other fruit. Think of it as a research and planning companion. It's a starting point for good questions, not the final word.

The most important part: Folia is a guide, not an authority

Please read this section closely. It's the heart of the agreement.

Folia gives you information, not professional advice. Everything the tool produces, the analyses, the scores, the considerations, the varietal suggestions, the maps, all of it, is for general information and learning. It is not agronomic, horticultural, engineering, environmental, surveying, real-estate, financial, legal, or tax advice, and using Folia doesn't make us your advisor.

Here's the honest truth about what Folia can and can't know. Its analysis is built from outside data that can be incomplete, out of date, or painted with a broad brush, and from models and assumptions that may not fit your exact piece of land. We can't and don't promise that a site will work out, that a crop or variety will succeed, or that any result is accurate, complete, or current. Whether something grows depends on weather, how it's managed, pests and disease, markets, and the countless details of a specific site that no remote tool can see.

So before you spend real money or make a real decision, check it for yourself. Walk the land. Talk to people who do this professionally, an agronomist, a viticulturist, a licensed surveyor, a soil scientist, your local cooperative extension. Confirm the boundaries, zoning, water rights, and permits with the offices that actually govern them. The decisions you make, and how they turn out, are yours.

We say all this not to hide behind fine print, but because it's genuinely how the tool should be used. Folia is at its best when it helps you ask sharper questions, not when it's treated as gospel.

Your account

You don't need an account to look around or run an analysis. If you make one to save your work, please give us a valid email and keep access to it secure, since that's how you sign in (through a one-time link, not a password). You're responsible for what happens under your account. If something looks off, like access you didn't authorize, email [email protected] and we'll help.

Using Folia fairly

A few things we ask you not to do:

• break the law or step on someone else's rights while using Folia;
• scrape, harvest, or bulk-extract data or content, or point bots at the site, unless we've said yes in writing;
• reverse engineer the software or try to pull out its source code, except where the law specifically allows it;
• disrupt or overload the site, or try to get into parts, or accounts, that aren't yours;
• repackage and resell Folia or its output as a competing data product; or
• pass off Folia's output as verified fact, professional advice, or a guarantee to someone else.

Sharing your properties

If we offer a feature that lets you share a saved property by a link, you're responsible for who you send that link to, and you can revoke the link at any time. Don't use sharing to distribute unlawful content or to violate anyone's rights. We may disable a shared link or a shared item if we believe it breaks these Terms or the law.

What you make, and what you tell us

Your stuff stays yours. The properties, drawings, answers, and other content you save are yours. You're just giving us permission to store, process, and show that content back to you, and to anyone you deliberately share it with, so the tool works. That's the whole scope of it.

Feedback. If you send us an idea or suggestion, thank you, genuinely. By sending it, you let us use it freely to improve Folia, with no strings attached and nothing owed to you.

Who owns Folia

Folia itself, the software, the design, the writing, the original content, belongs to us and is protected by law. You're welcome to use it: we give you a personal, limited license to access and use Folia for your own research and planning, including planning your own farm or operation. Everything we haven't expressly given you, we keep.

Some of the data and imagery you'll see comes from government and third-party sources, and it stays subject to their terms and attribution rules. If you reuse that underlying data, that's on you to do properly.

Other people's data and links

Folia leans on outside data and may link out to other sites. We don't control those, and we can't vouch for their accuracy, availability, or practices. Using them is at your own risk and under their terms, not ours.

The site is free, and it may change

Folia is free right now. We may add, change, pause, or retire parts of it whenever we need to, and we can't promise it will always be available, uninterrupted, or free of errors. We may also set limits on features. None of that creates a liability to you.

Ending things

You can stop using Folia anytime, and you can ask us to delete your account by emailing [email protected]. We can suspend or end access if we believe these Terms have been broken, or to protect the site or other people. The parts of this agreement that should outlive it, like the sections on Folia being a guide, ownership, and the disclaimers below, will keep applying.

The legal necessities

We've kept the tone plain throughout, but the next two sections use firmer legal language on purpose, because they have to hold up.

No warranties. Folia and everything it produces are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent the law allows, we disclaim all warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don't warrant that Folia or its results will be accurate, reliable, complete, current, secure, or uninterrupted, or that any site, crop, variety, or plan will be suitable or succeed. Some places don't allow certain warranty exclusions, so a few of these may not apply to you.

Limits on liability. To the fullest extent the law allows:

• We won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost crops, lost revenue, lost data, business interruption, or a drop in property value, arising from your use of, or inability to use, Folia or its results, even if we'd been warned such harm was possible.
• Our total liability for any and all claims relating to Folia or these Terms won't exceed the greater of what you paid us in the twelve months before the claim (which is zero today, because Folia is free) or one hundred U.S. dollars (US$100).

These limits are a basic part of our agreement. Some places don't allow certain limits, so some may not apply to you.

Covering us

If your use of Folia, your content, or your breaking of these Terms or the law causes a claim against us, you agree to cover the resulting costs, including reasonable attorneys' fees. In plain terms: if you misuse Folia and it lands us in trouble, that's on you, not us.

Which laws apply, and where disputes go

These Terms are governed by Maryland law, without its conflict-of-laws rules. Disputes go to the state or federal courts in Maryland, and you agree to that venue.

Changes to these Terms

We'll update this page as Folia grows. When we change something meaningful, we'll update the date at the top and, when it matters, tell you more directly. For material changes, we may ask you to accept the updated Terms before you keep using Folia. If you keep using Folia after a change, that means you accept the new version.

Odds and ends

• The whole deal. These Terms and the Privacy Policy are the complete agreement between us about Folia, and they replace anything said before.
• If one part fails. If a court finds any part unenforceable, the rest still stands.
• No waiver. If we don't enforce something right away, we haven't given it up.
• Handing it off. You can't transfer this agreement without our okay. We can transfer it if Folia is sold or merged.
• We're not partners. Using Folia doesn't make us partners, agents, or employer and employee.
